This website (the “Website”) is operated by GEL Labs (“GEL Labs,” “we,” “us,” or “our”). Please read these Terms & Conditions (“Terms”) carefully before using the Website. By accessing or using the Website, creating an account, placing an order, or submitting information through the Website, you agree to be bound by these Terms and our posted policies, including our Privacy Policy and Return/Refund and Shipping policies (collectively, the “Policies”).

Important notice: These Terms include a mandatory arbitration agreement and a class action waiver, which affect your legal rights. If you do not agree to these Terms, do not use the Website.

If we provide a manual payment option, you agree to follow the payment instructions provided at checkout and/or in order communications. Orders submitted using a manual payment method may remain unpaid until payment is confirmed. We may cancel unpaid orders after a stated time window.

Products offered by GEL Labs have not been evaluated by the U.S. Food and Drug Administration (FDA) unless explicitly stated otherwise. Products are not intended to diagnose, treat, cure, or prevent any disease.

We may remove Submissions at any time for any reason.

11) Modification or Discontinuation

The Website and all products and services offered through it are provided “as is” and “as available” to the fullest extent permitted by law. 13) Limitation of Liability

To the fullest extent permitted by law, GEL Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or lost data, arising out of or related to your use of the Website or any products purchased through it.

To the fullest extent permitted by law, GEL Labs’ total liability for any claim will not exceed the amount you paid to GEL Labs for the applicable order giving rise to the claim (or, if no payment was made, $100).

Some jurisdictions do not allow certain limitations; in those cases, limitations apply to the maximum extent permitted by law.

14) Indemnification

You agree to defend, indemnify, and hold harmless GEL Labs and its owners, officers, directors, employees, agents, affiliates, and contractors from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • your use or misuse of the Website

  • your breach of these Terms

  • your violation of any law or third-party right

15) Termination

17) Arbitration and Class Action Waiver

Informal resolution first

Before starting arbitration, you agree to contact us and attempt to resolve the dispute informally for at least 60 days.

Arbitration agreement

If we cannot resolve the dispute informally, you and GEL Labs agree that any dispute or claim arising out of or related to the Website, these Terms, or any transaction with GEL Labs will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable rules.

Location and format

Unless the parties agree otherwise, arbitration will take place in Massachusetts, and may be conducted by video, telephone, or written submissions when appropriate.

Class action waiver

You and GEL Labs agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

Exceptions

Either party may seek relief in small claims court for qualifying claims, or seek injunctive relief for misuse of the Website or unauthorized access.

18) Miscellaneous

  • Severability: If any provision is found unenforceable, the remaining provisions remain in effect.

  • No waiver: Failure to enforce a provision is not a waiver of the right to enforce it later.

  • Assignment: You may not assign your rights or obligations without our written consent; we may assign our rights as part of a business transfer.

  • Entire agreement: These Terms and Policies are the entire agreement between you and GEL Labs regarding the Website.

19) SMS Marketing

If you opt in to receive marketing text messages from GEL Labs, you agree to receive promotional and informational SMS messages at the mobile number you provide.
